Boss Threatening Us With Bad Job Reference.

Hi,


Please advice on this. Our line manager is constantly indirectly threatening us with bad reference over trivial matters if we ever get jobs elsewhere.
Is this in order? At what point do prospective employers seek for reference from former employers? If
they do, is it the HR who provides this information or the line manager?

After leaving a job, a former employer is free to pass along negative information about you to prospective employers, and laws protect them from legal recourse provided the information is – job related; based upon credible evidence; and made without malice.

It is illegal for a former employer to purposefully give false information for the sake of harming one’s reputation or preventing one from obtaining employment. In addition, personal information that is not job related should neither be asked about or provided by either a prospective or former employer.

I’ve seen a number of employees in their first jobs, who may not like the job as they aren’t used to a real paid job and the duties that are involved, so they take a lot of sick days, turn up late, etc. I give a friendly warning or piece of advice and tell them to do something about it instead of not turning up, as if they get bad references for their first few jobs it may affect them in future

It’s an employers duty to ensure a given reference is fair and accurate, truthful and not misleading. if an employer does give a reference that could be considered bad, it’s up to the employee to take action. The ex employer doesn’t necessarily have to let the employee see the reference, and likewise the new employer, so it makes it difficult for an employee to take action against a bad reference

Most employers will avoid giving “bad” references by simply sticking to facts of attendance, or not giving a reference at all, as they simply don’t want any comebacks afterwards. The employer may be glad to see the back of a problematic employee.

In most cases these days a new employer will usually want to check references for the past employment, and will send a standard form for completion, which will usually ask for ratings out of 5 on topics such as attendance, timekeeping, suitability of job, co-operation with colleagues, honesty, etc, so an ex employer can easily give a reply without giving any further details. The forms will also usually have a further comments section, which i imagine would normally only be used if the ex employer wants to ensure the employee gets a good reference, but sometimes you can get some alarming comments

Former employers who fear potential defamation and law suites have become crafty when answering employment reference questions. Rather than speak negatively about a former employee, some will opt to “No Comment” when asked critical employment questions regarding performance, termination, and eligibility for rehire. The inference of this is just as harmful to the employee as a bad reference, and if a prospective employer has to choose between two qualified applicants – one with positive references and the other with mediocre or bad references – who do you suppose they will choose?

Another common practice among employers is to refuse to give any information about an employee other than dates of employment and title. This is gross disservice to an employee who has dedicated years of faithful service to a company, yet gets no better of a reference then an employee who was fired for stealing from the petty cash.

Unfortunately, this policy is within the legal rights of an employer-A Kenyan employer cannot be forced to give you a reference letter. You are only entitled to a certificate of service.

So, you have to beware of leaving jobs on a bad note as anything can happen. most people will have an idea if their employer usually follows good practice or not, so if you work at a place of employment that regularly has rumors of malpractice or perhaps unfairly dealing with staff, that’s where you have to be careful of leaving on a good note

I can’t imagine many employers accepting references that are given to them by the employee. I wouldn’t trust a reference unless i wrote to the employer myself, and I’d normally address it to the HR department to deal with, rather than a named individual, so i don’t get a reference written by a friend. I’d imagine most HR departments would also do the same. You write giving the facts that the employee has stated, including the employers line managers name, and ask for them to be confirmed in writing

If all else fails, you may need to simply warn prospective new employers that the reference won’t be a good one. And you do want to give this warning, because it allows you to provide context and framing for what they might be about to hear. If you don’t, they may never tell you that the reference is why they rejected you, so the time to speak up is before they place the call. How you explain it depends on exactly what’s behind the bad reference, but your goal is to put it in the best possible light. For instance, if your relationship with your boss soured after a particular event, you could say something like, “By the way, I had a very good reviews from my boss at that job, but our relationship became strained toward the end and I worry that it could get me a negative reference.” Be prepared for questions about what caused the strain, of course.

1. An employer can give a bad reference provided its accurate and factual.

2. Most employers will contact HR directly or senior managers. HR managers are custodian of your personal file that contains sensitive information like promotions, warning, training etc. Some companies can also request for references from direct supervisors but the norm in our context is the HR managers. HOWEVER…alot of info that HR has on you is from your direct supervisor.

3. You can challenge a bad reference in a court of law.

4. A reference letter will normally be sent after you’ve accepted the job offer but awaiting confirmation. Thats why we have the probation period.

  • Ability to set priorities and clear targets
  • Able to deliver under pressure and under minimum supervision

  • High integrity and strong ethical values.
  • Willing to work for long hours
